The initially breathalyser test that showed the presence of alcohol in Kurt Busch's test was four times below the legal limit.
Maricopa County sheriff's office told the Associated Press that Busch had a 0.017 blood-alcohol level on his preliminary test, well below the states' limit of 0.080.
However, Busch was charged with reckless driving after reportedly running a stop sign, and faces a court appearance in December.
